Terms of Use and Directory Terms
Last updated: September 1, 2026
These Terms of Use and Directory Terms (the “Terms”) govern your use of cliftonparkspark.com and its related pages, forms, directory listings, and services (collectively, the “Site”). The Site is operated by 3tone Digital under the Clifton Park Spark brand (“Clifton Park Spark,” “we,” “us,” or “our”). By using the Site, submitting information, claiming a listing, or purchasing a service, you agree to these Terms. If you do not agree, do not use the Site.
1. About Clifton Park Spark
Clifton Park Spark is an independent local media, information, business-directory, and digital-services website. Unless a page expressly says otherwise, Clifton Park Spark is not affiliated with, sponsored by, endorsed by, or operated by the Town of Clifton Park or any other government agency.
2. Informational content
Site content is provided for general informational purposes. We make reasonable efforts to provide useful and current information, but we do not guarantee that an article, event, address, phone number, business status, category, map location, hours, price, service description, or other information is complete, current, or error-free.
Content may be corrected, updated, archived, restricted, or removed at any time. You should verify important information directly with the relevant business, organization, or official source before relying on it.
3. Business-directory listings
Directory listings may be created from information supplied by a business or its representative, business websites, public records, publicly available sources, user submissions, or our own research. A listing does not mean that Clifton Park Spark endorses, recommends, certifies, licenses, insures, or has independently vetted the listed business.
We may create, categorize, edit, combine, decline, suspend, or remove a listing in our reasonable discretion. We do not guarantee any business a listing, a particular category or position, continued publication, traffic, or visibility.
Business owners and authorized representatives may request a correction, claim review, or removal under our Business Listing Correction and Removal Policy. Removal of a directory listing does not require us to remove separate news reporting, reviews, comments, public-record reporting, historical archives, or other editorial material.
4. Claiming a listing
By claiming or requesting control of a listing, you represent and warrant that:
- you are the business owner or are authorized to act for the business;
- the information and documents you provide are accurate and not misleading;
- your requested content does not violate any law or third-party right; and
- you will promptly tell us when material business information changes.
We may request verification and may reject, suspend, or revoke a claim if authority or accuracy cannot be verified, a dispute arises, payment stops, or these Terms are violated. Claiming a listing does not transfer ownership of the Site, its software, templates, layout, or editorial content.
5. Content supplied by businesses and users
You keep ownership of material you submit, such as your logo, photographs, trademarks, copy, and contact information. You give us a non-exclusive, worldwide, royalty-free license to host, reproduce, resize, edit for formatting or clarity, display, distribute, and promote that material as reasonably necessary to operate and market the Site and your listing.
You represent that you have the rights and permissions needed to submit the material. Do not submit confidential information, unlawful content, malware, deceptive claims, content that infringes intellectual-property or privacy rights, or content that is defamatory, threatening, discriminatory, or obscene.
We may reject or remove submitted material. We are not responsible for keeping backup copies of material you submit.
6. Paid listings and subscriptions
Paid listing services are also governed by our Paid Listing, Cancellation, and Refund Policy, which is incorporated into these Terms. If there is a conflict concerning billing, cancellation, included work, or paid-listing benefits, that policy controls.
Paid placement or featured status does not influence Clifton Park Spark’s independent news or editorial decisions. Payment does not guarantee favorable coverage, removal of legitimate editorial content, search-engine rankings, website traffic, leads, conversions, or revenue.
7. Lead forms
Some paid listings may include a lead form that sends visitor-submitted inquiries to the email address selected by the listed business. Clifton Park Spark is not a party to communications or transactions between a visitor and a listed business. We do not guarantee that an inquiry is genuine, accurate, lawful, deliverable, or free from spam, and we do not guarantee successful email delivery.
Businesses receiving leads are responsible for their own privacy notices, recordkeeping, follow-up, marketing consent, and legal compliance. A business may not use lead information for unlawful, deceptive, abusive, or unauthorized marketing.
8. Editorial independence
Directory claims, advertising relationships, and paid services do not give a business approval rights over Clifton Park Spark’s reporting or editorial content unless we expressly agree in writing. A listing-removal request is not a demand to suppress truthful reporting, public records, opinions, archives, or other separately published editorial material.
9. Acceptable use
You may not misuse the Site, interfere with its operation, attempt unauthorized access, scrape or copy substantial portions of the directory, submit false ownership claims, manipulate view counts, use forms to send spam, introduce malicious code, or use Site content in a misleading way.
10. Intellectual property
Except for material owned by businesses, users, licensors, or other third parties, the Site’s design, branding, software, original text, graphics, page layouts, and compilations are owned by or licensed to 3tone Digital and are protected by applicable law. No right is granted except the limited right to use the Site under these Terms.
11. Third-party services and links
The Site may link to or use third-party services, including listed-business websites, maps, payment processing, embedded media, forms, analytics, email, and social platforms. We do not control and are not responsible for third-party content, availability, security, terms, or privacy practices. Your use of a third-party service is governed by that service’s terms.
12. Disclaimers
To the fullest extent permitted by law, the Site and its content and services are provided “as is” and “as available,” without warranties of any kind, express or implied. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that listings, inquiries, maps, links, or third-party information will be accurate or reliable.
Nothing in these Terms excludes a warranty or right that cannot legally be excluded.
13. Limitation of liability
To the fullest extent permitted by law, Clifton Park Spark, 3tone Digital, and their contractors and representatives will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, lost revenue, lost data, reputational harm, missed opportunities, or business interruption arising from the Site or services.
To the fullest extent permitted by law, our total liability for any claim relating to the Site or a paid service will not exceed the greater of $100 or the amount you paid us for the affected service during the three months before the event giving rise to the claim.
These limits do not apply where liability cannot legally be limited.
14. Indemnification
To the fullest extent permitted by law, if you submit content, claim a listing, or purchase a business service, you agree to defend, indemnify, and hold harmless Clifton Park Spark, 3tone Digital, and their contractors and representatives from third-party claims, losses, liabilities, and reasonable costs arising from your submitted material, false claim of authority, unlawful use of lead information, violation of these Terms, or infringement of another person’s rights.
15. Suspension and termination
We may restrict or terminate access, remove submitted content, revoke a listing claim, or suspend a paid feature if these Terms are violated, payment fails, continued service creates legal or security risk, or a listing is fraudulent or misleading. Billing and cancellation remain governed by the Paid Listing, Cancellation, and Refund Policy.
16. Changes to these Terms
We may update these Terms by posting a revised version and changing the “Last updated” date. If a change materially affects an active paid subscription, we will provide notice as required by applicable law. Continued use after the effective date of a revision means you accept the revised Terms, except where additional consent is required by law.
17. Governing law and venue
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any legal action that is not subject to another written agreement must be brought in a state or federal court with jurisdiction in Saratoga County, New York. Nothing in this section deprives a person of a non-waivable right under applicable law.
